FormPost Terms of Service

0. Important Disclaimer

FormPost is a technical platform provider. We do not control the content submitted or processed by users. Responsibility for legality, accuracy, and third-party rights lies solely with the user.

You confirm that you are not subject to sanctions of the EU, USA, UN, or other jurisdictions, and that you are not using the Service on behalf of restricted entities or countries. FormPost reserves the right to suspend or terminate access immediately in case of violations.

1. Agreement Between User and FormPost

These Terms (“Agreement”) are a legally binding contract between you and FormPost LLC. By using any of our services (including simply browsing the website), you agree to these Terms. If you disagree — stop using the service.

Note: Section 13 contains mandatory arbitration provisions.

2. Privacy and Personal Data

• Your privacy is governed by the Privacy Policy, which forms part of these Terms.
• FormPost performs only technical data processing.
• You are responsible for compliance with the Law of Ukraine on Personal Data Protection, as well as international norms (GDPR, CCPA) regarding third-party data.
• If FormPost suffers penalties or lawsuits due to your actions — you shall reimburse damages (see Section 10).

3. Electronic Communication

Email correspondence, clicking “I Agree,” or using the Service constitutes an electronic signature with legal effect.

4. Account

• You are responsible for keeping your password and account secure.
• FormPost is not liable for unauthorized access due to your negligence.
• Age restriction: the Service is not intended for individuals under 18.

5. Third-Party Services

The site may contain links to third-party services. FormPost does not control them and bears no responsibility for their content or policies. For service operation, we may share minimal data with trusted partners (hosting, payments, analytics).

6. Prohibited Use

• Illegal purposes;
• Violating copyright or third-party rights;
• Uploading/distributing malicious code, spam, or viruses;
• Phishing, fraud, promotion of violence or hate speech.

7. Intellectual Property

You receive a limited, non-exclusive license to use FormPost under these Terms. Copying or modifying site elements without prior written consent is prohibited.

8. Confidential Information

Both parties agree to maintain confidentiality of exchanged information.

Exceptions: information already public; independently obtained; disclosure required by law or court order.

9. International Users

The Service is operated from Ukraine. By using it outside Ukraine, you are solely responsible for compliance with local laws.

You agree to indemnify FormPost for damages caused by violations of these Terms, unlawful use of the Service, or third-party claims.

11. Disclaimer of Warranties

FormPost is provided “as is.” We do not guarantee uninterrupted operation, absence of errors/vulnerabilities, or the legality/accuracy of user content.

12. Limitation of Liability

FormPost is not liable for direct or indirect damages, loss of profit or data. Maximum liability is limited to the amount you paid for services in the last 3 months.

13. Disputes and Arbitration

• Ukrainian law applies.
• Disputes are resolved in the ICAC at the Ukrainian CCI, Kyiv.
• Class actions are waived to the extent permitted by law.

14. Refund Policy

Payments are non-refundable, except as expressly required by Ukrainian law. Accounts may be blocked in cases of fraud or abuse.

15. Public Use

FormPost may list you as a client in marketing materials, unless you explicitly prohibit such use in writing.

16. Termination

We may suspend or terminate your account without notice in case of violation. Liability and confidentiality provisions survive termination.

17. Changes to Terms

We may update these Terms. Notice will be provided at least 7 days before changes take effect. Continued use means acceptance of the updated Terms.

FormPost does not control your content. You guarantee you have the rights and that it complies with laws and third-party rights.

FormPost complies with copyright law. Report claims to formpostorg@gmail.com. We may restrict access or remove disputed content.
